Sutton Wealth — Terms of Service

1. Agreement to Terms
By accepting access to the Sutton Wealth platform, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the platform.
These Terms form a binding legal agreement between you and Cornerstone Platform Inc. ("Cornerstone," "we," or "us"), the operator of the Sutton Wealth platform, incorporated in British Columbia, Canada. Sutton Wealth is the branded experience through which you access the platform. Sutton Group Realty Services Ltd. is the Network Partner that offers the Sutton Wealth experience through its professional network. Cornerstone is the operator of the platform and your contracting party under these Terms.
These Terms apply to all users of the platform. Where a section applies specifically to Homeowners, Portfolio Issuers, or Trust Network Members, it is identified as such. Otherwise, "you" refers to any user in any role.
2. Access and Eligibility
Access to Sutton Wealth requires association with an authorized Portfolio Issuer. Every account on the platform is linked to a Portfolio Issuer who is responsible for initiating the portfolio and who participates in the Cornerstone Network under the terms governing that role. This applies whether your account was created through an invitation or through any other access method we may offer in the future.
To use Sutton Wealth you must be a Canadian resident aged 18 or older with the legal authority to enter into a binding agreement.
3. Description of the Service
Sutton Wealth is a property portfolio management and wealth visibility platform. The platform enables homeowners to build and manage a verified digital property portfolio and to share it, on a permissioned basis, with the people and professionals they trust. Portfolio Issuers and Trust Network Members may access portfolio data only to the extent explicitly authorized by the Homeowner.
Sutton Wealth is a platform, not an adviser. The data, valuations, and insights available through the platform are provided for informational purposes and do not constitute financial, investment, legal, mortgage, tax, or real estate advice. They should not be relied upon for significant decisions without independent verification.
The platform is designed to help homeowners engage more meaningfully with the people in their trust network — including family, friends, and professionals — by giving those people access to verified, organized property information. Any advice, guidance, or recommendations you give or receive come from the individuals in that network, not from Cornerstone. Cornerstone does not endorse, warrant, or accept responsibility for the advice or services provided by any person on the platform.
4. User Roles and Trust Network
The platform supports three user roles.
Homeowner — the individual who owns and controls the portfolio. All access by others is at the Homeowner's discretion and may be changed at any time.
Portfolio Issuer (PI) — the professional who initiates the portfolio on the Homeowner's behalf. The Portfolio Issuer is automatically a Trust Network Member and remains associated with the portfolio.
Trust Network Member (TNM) — any person the Homeowner admits to their trust network. Trust Network Members may include family members and friends — such as a spouse or partner, parent, child, sibling, or trusted friend — as well as professionals such as real estate agents, lawyers, mortgage brokers, financial advisers, and insurance brokers, or any other person the Homeowner chooses to include (collectively, "professionals" where referred to in that capacity in these Terms). Access is entirely at the Homeowner's discretion.
5. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you suspect unauthorized access, notify us immediately at support@suttonwealth.ca. Your account is secured with two-factor authentication. We reserve the right to suspend or terminate accounts showing signs of unauthorized access, misuse, or breach of these Terms.
6. Accuracy of Information
By using the platform, you represent and warrant that all information you provide during account setup and onboarding is accurate and complete to the best of your knowledge, and that you will promptly update it if it becomes inaccurate. We are not liable for errors in your portfolio that result from inaccurate information you provided.
7. Identity Verification
During onboarding, Homeowners will be asked to verify their identity through an authorized third-party identity verification provider. Cornerstone does not collect, store, or retain biometric data, government-issued identification documents, or banking credentials. We receive only the verified identity attributes necessary to establish trust in your account. The verification process is handled by the third-party provider and is subject to that provider's own terms and privacy policy. For details on what we receive and store, see our Privacy Policy.
8. Third-Party Data and Services
The platform integrates with third-party services to deliver its functionality. Data sourced from third-party providers may contain errors, delays, or omissions. Cornerstone does not guarantee the accuracy, completeness, or timeliness of any third-party data displayed on the platform. You should verify data independently before making significant financial, legal, or investment decisions. Your use of third-party services is subject to their respective terms and privacy policies. 9. Verifiable Credentials
Sutton Wealth issues verifiable credentials as part of its trust infrastructure. A verifiable credential is a cryptographically signed, tamper-evident digital record attesting to a verified fact — such as your identity, your ownership of a property, or your status as an authorized professional. Any party with whom it is shared can verify its authenticity independently.
Credentials are held securely on the platform on your behalf and are accessible only within your authenticated session. The platform uses credentials to support access control and permissioning to portfolios and platform services — this is how trust is established and maintained.
Credentials can also be stored on a personal digital wallet on your own device. When this capability is available, you will be able to hold, manage, and present your credentials entirely independently of the platform.
10. Portfolio Sharing
No portfolio data is shared without the Homeowner's explicit consent. The Homeowner determines what data is shared and with whom, and may withdraw access at any time through their account settings. When access is withdrawn, the recipient's ability to view that data through the platform is terminated.
Professionals who have received access to portfolio data are responsible for handling it in accordance with their applicable professional obligations and must not use it beyond the purpose for which access was granted. Upon withdrawal of access by a Homeowner, professionals must treat any data retained outside the platform in accordance with those same obligations.
All other Trust Network Members are expected to respect the purpose for which access was granted and to treat the Homeowner's data with appropriate care.
Cornerstone is not responsible for how recipients use data the Homeowner has authorized them to see, or for data retained outside the platform prior to withdrawal of access.
11. Professionals — Additional Obligations
Professionals using Sutton Wealth must use the platform only for lawful purposes in connection with services they are providing to the Homeowner, and must comply with all applicable professional standards, regulations, and codes of conduct.
Where a professional holds a licence, registration, or designation applicable to the services they provide, they are responsible for maintaining that status in good standing. Cornerstone does not independently verify professional standing. Where the platform issues a professional credential, it does so on the basis of attestation provided by a recognized organization, authority, or other attesting party — Cornerstone is the issuer of the credential, not the source of the underlying claim. The attesting party is responsible for the accuracy of what they have attested to.
Cornerstone reserves the right to suspend access where misuse is identified.
12. Acceptable Use
You must not use the Sutton Wealth platform to:
- Engage in any unlawful activity
- Access data belonging to other users without authorization
- Reverse-engineer, scrape, decompile, or interfere with the platform or its underlying systems
- Circumvent any consent, permission, access control, or credentialing mechanism
- Upload malicious software, harmful content, or materials that infringe third-party rights
- Impersonate any person, entity, or professional credential
- Attempt unauthorized access to any system, account, or data
13. Intellectual Property
Cornerstone Platform Inc. owns all rights to the Sutton Wealth platform, including its software, design, data schemas, credential systems, and any derived data products. Your use of the platform does not transfer any ownership rights to you. You grant Cornerstone a limited, non-exclusive licence to process your content for the purpose of delivering the services described in these Terms. This licence ends when you delete your content or close your account.
14. Email Communications
The platform sends transactional emails necessary for the operation of your account. If we introduce commercial or promotional communications, we will obtain your explicit consent as required by Canada's Anti-Spam Legislation (CASL) and every such message will include a working unsubscribe mechanism.
15. Disclaimers
To the maximum extent permitted by applicable law, the Sutton Wealth platform is provided "as is" and "as available", without any warranty, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Cornerstone does not warrant that the platform will be uninterrupted, error-free, or free of harmful components, does not guarantee the accuracy, completeness, or timeliness of any data displayed on the platform, does not endorse or recommend any professional, product, or service accessed through the platform, and cannot guarantee the security or confidentiality of information transmitted electronically.
16. Limitation of Liability
To the maximum extent permitted by applicable law, Cornerstone is not liable for any decisions made based on data or insights displayed on the platform, for errors or inaccuracies in data sourced from third-party providers, or for any indirect, consequential, incidental, punitive, or special damages including loss of profit, loss of data, or loss of opportunity. Cornerstone's total aggregate liability for any claim arising under or in connection with these Terms will not exceed the greater of the total fees you paid to Cornerstone in the 12 months preceding the claim, or CAD $500 where the service was provided at no direct charge. This cap does not apply to claims arising from a breach of your personal information, or to liability that cannot be lawfully limited under applicable Canadian law.
17. Indemnification
To the extent permitted by applicable consumer protection law, you agree to indemnify and hold harmless Cornerstone Platform Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your negligent or wilful acts in connection with your violation of these Terms, your infringement of any third-party rights, or any deliberately inaccurate information you provided to the platform.
18. Termination
You may request deletion of your account at any time by contacting privacy@cornerstoneplatform.ca or through your account settings. Your personal data will be deleted in accordance with our Privacy Policy.
We may suspend or terminate your access to the platform at any time where we determine that you have violated these Terms or where continued access poses a risk to the platform, other users, or applicable law. Where your account is suspended, you may contact support@suttonwealth.ca to discuss reinstatement.
Upon termination, your licence to use the platform ends immediately. Sections 6, 12, 13, 15, 16, and 17 survive termination.
19. Changes to These Terms
We may update these Terms at any time. Changes will be posted on the platform with an updated date. Continued use of the platform after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you may request deletion of your account.
20. Governing Law
These Terms are governed by the laws of British Columbia and the applicable federal laws of Canada. Any dispute arising under these Terms will be resolved exclusively in the courts of British Columbia.
